Pursuant to section 602.160 of the Canadian Aviation Regulations (CARs), I hereby exempt Canadian North Inc. carrying on business as Canadian North (hereinafter referred to as Canadian North), 200 - 680 Palmer Road N.E., Calgary, Alberta, T2E 7R3, from the requirements set out in subsection 602.157(2) of the CARs subject to the following conditions.
Subsection 602.157(2) states that every air operator, who is a new entrant, that did not report an original base level to the Minister in writing, shall ensure that the number of Chapter 3 aeroplanes in its fleet, expressed as a percentage of its fleet, is equal to or is greater than the percentage set out in Column III of Table 2.
Purpose
The purpose of this exemption is to permit Canadian North to operate two (2) Chapter 2 gravel kit equipped aeroplanes exceeding MCTOW 34,000 kg, for northern operations in accordance with section 602.161 of the CARs.
Application
The exemption applies to Canadian North when operating two (2) Chapter 2 gravel kit equipped aeroplanes under the Air Operator Certificate # 10,008 for its northern operations. Specifically, the aircraft covered by this exemption are:
- Aircraft 552 Registration: C-GFPW Serial Number 21294
- Aircraft 562 Registration: C-GNDU Serial Number 22877
Conditions
This exemption is subject to the following conditions:
- Canadian North Inc. shall serve the northern communities listed in Appendix B the using aeroplanes specified in this exemption only;
- Aircraft 552 Registration: C-GFPW Serial Number 21294
- Aircraft 562 Registration: C-GNDU Serial Number 22877
- Canadian North Inc. shall not take off or land the aeroplanes at any aerodromes that are south of the designated area, as defined in Appendix A, except for the following:
- Edmonton International Airport (YEG);
- Calgary International Airport (YYC);
- Ottawa Macdonald-Cartier International Airport (YOW);
- Toronto Lester B. Pearson International Airport (YYZ);
- Vancouver International Airport (YVR);
- Winnipeg International Airport (YWG)
- Canadian North Inc. shall be in continued compliance with section 602.161 of the CARs throughout the validity period of this exemption;
- Canadian North Inc. shall equip the aeroplanes specified in this exemption with suitable gravel runways kit; and
- Canadian North Inc. shall carry a copy of this exemption in the journey log book of each aeroplane subject to this exemption.
Validity
This exemption is valid until the earliest of:
- 23:59 EDT on June 30, 2009;
- The date on which an amendment to the relevant sections of the CARs, addressed specifically in this exemption, comes into effect;
- The date on which any condition specified in the exemption is not complied with; or
- The date on which the exemption is canceled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or it is likely to affect aviation safety.
CANCELLATION
The exemption (NCR 081-2006) from subsection 602.157(2) of the CARs issued on June 23, 2006, at Ottawa, by the Director General, Civil Aviation, on behalf of the Minister of Transport, Infrastructure and Communities is hereby canceled because it is the opinion of the Minister that it is no longer in the public interest or is likely to affect aviation safety.

APPENDIX “A”
“designated area” means, that part of Canada north of a line described as follows:
- commencing on the point of intersection of the Atlantic coast of Canada with the 50th parallel,
- thence west along the 50th parallel to the point of intersection of that parallel with the border of Ontario and Manitoba,
- thence northwesterly along a straight line drawn from the intersection of the 50th parallel with the border of Ontario and Manitoba to the intersection of the 53rd parallel with the border of Manitoba and Saskatchewan,
- thence northwesterly along a straight line drawn from the intersection of the 53rd parallel with the border of Manitoba and Saskatchewan to the intersection of the 55th parallel with the border of Saskatchewan and Alberta and
- thence west along the 55th parallel to the Pacific coast of Canada.
